Stocks rally strongly as earnings concerns ease

Updated at 4:10 p.m. ET: Stocks rallied strongly Tuesday after stronger-than-expected quarterly earnings from such bellwethers as Goldman Sachs and Johnson & Johnson helped ease concerns about a dismal quarterly earnings season.

The Dow Jones industrial average closed the day up 128 points, near the highs of the day.

Dow components Johnson & Johnson and UnitedHealth Group both raised their full-year profit views while Goldman Sachs increased its dividend.

Goldman Sachs shares gained after the banking company posted earnings that beat expectations and revenue that more than doubled. Goldman's results followed earnings in the two previous sessions from Citigroup Inc, JP Morgan Chase & Co and Wells Fargo.

Shares of Johnson & Johnson, the diversified U.S. healthcare company, rose. In contrast, UnitedHealth fell.

The market?s advance comes on the heels of last week's 2.2 percent slide. That was the benchmark index's worst weekly decline in four months as investors looked for more evidence on the global economic climate from large multinational companies.

"One of the biggest things coming into this earnings reporting season was this drumbeat for how bad it was going to be," said Art Hogan, managing director of Lazard Capital Markets in New York.

"We went through a period of time last week where we focused on how bad it was going to get, and we've got a chance to get some of that back because the worst-case scenario is not playing out."

Coca-Cola Co also reported a rise in earnings, but quarterly revenue came in short of Wall Street's expectations, hurt by declines in Europe and Asia.

Citigroup unexpectedly announced that Chief Executive Vikram Pandit has resigned effective immediately, along with Chief Operating Officer John Havens. Michael Corbat, previously chief executive for Europe, Middle East and Africa, was named to succeed Pandit.

The announcement came one day after a surprisingly strong quarterly earnings report.

"It certainly is a bit of a shock," said Jeff Morris, head of U.S. equities at Standard Life Investments in Boston. "Certainly the transitioning and the messaging was more abrupt than I think anybody would have anticipated."

As earlier profit warnings from large multinationals left investors leery of the third-quarter earnings season, Tuesday's earnings helped decrease concerns about the global economy. Materials stocks, closely tied to economic fortunes, were the S&P 500's best performers.

Quarterly profits of S&P 500 companies are seen dropping 2.3 percent from the year-ago period, according to Thomson Reuters data through Tuesday morning. With about 10 percent of S&P companies having reported, 60 percent have topped profit expectations, under the average beat rate of 67 percent for the past four quarters.

Economic data showed the overall U.S. Consumer Price Index rose 0.6 percent in September as the cost of gasoline surged, posing a threat to consumers' spending power. On the other hand, inflation pressures look unlikely to derail the Federal Reserve's ultra-easy policy path.

So-called Anaplastic Large Cell Lymphoma (ALCL) is even less attractive in real life than it is on paper. It is a highly aggressive type of lymphoma that generally occurs in children and young adults and that has to date proven extremely difficult to treat. It has long been known that ALCL patients frequently show a genetic alteration (a translocation) that causes expression of nucleophosmin-anaplastic lymphoma kinase (NPM-ALK), a gene known to be capable of giving rise to cancer. But how the NPM-ALK gene works has to date remained largely a matter of conjecture.

Working in a mouse model for lymphoma, Karoline Kollmann in Veronika Sexl's group at the University of Veterinary Medicine, Vienna and colleagues in the Ludwig Boltzmann Institute for Cancer Research and the Medical University of Vienna were able to show that the development of lymphoma is absolutely dependent on the "Platelet derived growth factor receptor B" (PDGFRB), a protein already associated with the growth of other types of tumour. They demonstrated that the effect was direct, with NPM-ALK stimulating the production of the transcription factors JUN and JUNB, which bind to and activate the PDGFRB promoter. And importantly they were able to show that inhibition of PDGFRB with the drug imatinib was able to extend dramatically the survival of mice with this kind of lymphoma.

In human patients, ALCL is traditionally treated with crizotinib, a drug that directly inhibits the NPM-ALK protein. The major problem is that the patients tend to relapse and their chances of survival are extremely poor. Based on the results from the imatinib tests in mice it seemed conceivable that the use of this drug might improve the prognosis of patients who do not or no longer respond to crizotinib therapy. The scientists obtained ethical approval and informed consent to attempt imatinib treatment of an ALCL patient who had not responded to conventional chemotherapy and had relapsed after transplantation of stem cells. Remarkably, the patient improved immediately upon imatinib treatment: after ten days he was in complete remission and he is still alive ? and again working ? 22 months later.

The idea of inhibiting PDGFRB in ALCL is novel and potentially of great therapeutic importance. Kollmann is naturally extremely excited by the implications of the results. "The patient had essentially run out of options and would have died a long time ago. But thanks to the indications from our mouse work that inhibiting PDGFRB could prevent growth of this type of tumour he is still alive. This new type of therapy could significantly prolong patient survival."

Intriguingly, the researchers have also found that PDGRFB is also present in ALCL patients without the translocation that leads to NPM-ALK expression. Whether the PDGRFB protein is required for the development of tumours in such patients is not yet clear but it is possible that a combined crizotinib / imatinib therapy might be more widely applicable, providing hope for patients suffering from other types of lymphoma.

Antibody stops stomach cancer spread

Monash Institute of Medical Research scientists may have discovered a way of blocking stomach tumours from growing and spreading, according to a paper published in the highly-prestigious journal Cancer Cell, which is ranked in the top five science and medical research journals in the world, including Nature, Cell and Science.

Stomach, or gastric, cancer is the second most lethal cancer in the world, and being one of the most aggressive forms of cancer it is also placed among the world?s top five cancers with the lowest survival rates.

In a world-first, MIMR?s Associate Professor Brendan Jenkins and his team from the Centre for Innate Immunity and Infectious Diseases have identified that a gene, which creates a protein called Toll-Like Receptor 2, is over-produced in the stomachs of gastric cancer patients.?

They have also identified why this happens.

Completing the trifecta, A/Prof Jenkins and his team have also demonstrated that TLR2 promotes the growth of gastric cancer tumour cells, and by using an antibody can block the actions of TLR2, thus preventing further tumour growth and potentially spreading (metastasis).

?One of the main problems with stomach cancer is that it?s a very aggressive disease and is often only detected at an advanced stage where you are restricted to harsh treatments such as chemotherapy, radiotherapy and surgical resection,? A/Prof Jenkins said

?These can have quite dire consequences in terms of the patient?s quality of life, and often are not highly effective at preventing tumours from regrowing or significantly improving the survival rate of patients.

?So there?s a very strong need for new next-generation therapeutics for gastric cancer to overcome these issues? he said.?

A/Prof Jenkins? findings now create the potential for personalised therapeutic treatment.

They also highlight the need and pave the way for early detection.

?Using TLR2 and other related disease biomarkers we?ve identified could enhance screening programs to capture stomach cancer in its early stages and allow us to block further tumour growth before it has a major detrimental effect on peoples? lives,? he said.

A/Prof Jenkins and his team collaborated with several international groups including Dublin-based pharmaceutical company Opsona, which provided the antibodies, as well as the Genome Institute of Singapore and Japan?s Kanazawa University.

Despite his findings, A/Prof Jenkins is still very cautious about his research?s blanket potential.

?If we prove antibody-mediated therapy against TLR2 is efficacious in our pre-clinical models, we still couldn?t say that it can treat every gastric cancer patient ? that?s just unrealistic,? he said.?

?At this stage we don?t know exactly what percentage of stomach/gastric cancer patients worldwide would have increased amounts of the TLR2 gene (and protein) and therefore, how many gastric cancer patients would respond to or benefit from this.

?But you?re looking at a percentage of advanced gastric cancer patients ? around 20-30 per cent based on our numbers so far ? that we believe would benefit.

?In five years from now I would like to see this treatment in the clinics with people receiving and benefiting from it, which means hopefully that it will provide them with an improved quality of life,? A/Prof Jenkins said.?

Cancer Council Victoria?s CEO Todd Harper said the Cancer Council has been instrumental in funding A/Prof Jenkins? research.

?We?re excited about the initial results of A/Professor Jenkins? work ? particularly as it relates to a cancer which presently has such a low survival rate.

?Our priority is to fund life-saving cancer research so we?re eager to see what developments will be made with these findings,? Mr Harper said.?

1. White and dark chocolate chip blondies

2-1/2?cups all-purpose flour
1?teaspoon baking soda
1?teaspoon salt
2?cups packed light brown sugar
1?cup?(2 sticks)?butter, softened (I used 1 stick butter, 1 stick margarine)
1?teaspoon vanilla extract
2?large eggs
3/4 cups white chocolate chips
3/4 cups dark chocolate chunks
1/2 cup walnuts, chopped
1/2 cup toasted coconut

Preheat the oven to 350 degree F. Grease 13 x 9-inch baking pan.?

Combine flour, baking soda and salt in small bowl. Beat brown sugar, butter, and vanilla extract in large mixer bowl until creamy. Add eggs one at time, combining well before adding the second egg; beat until light and fluffy. Gradually stir in flour mixture.

Stir in chocolate chips, walnuts, and coconut.?Spread into prepared pan.?

Bake?for 30 to 35 minutes or until golden brown. Cool completely in pan on wire rack. Cut into bars.

DHL Express will support the Irish Cancer Society through a number of initiatives including various fundraising activities, creating innovative logistic solutions and developing volunteer programmes.

The charity will also take part in First Aid and health and safety courses run by qualified DHL Express trainers.?

How to Install Shingles on Your Roof | RichNSpect

Not many of us are brave enough to install shingles ourselves, but for those who are, below you?ll find some helpful tips and a simple guide on shingle installation.

Supplies You?ll Need

Of course, you?ll need roofing feltand shingles; your local home improvement or roofing supply store can assist you in finding the product which will best suit your needs. You will also need other items such as plastic cap and standard roofing nails, tar paper, vents, flashing and roof sealant.

Equipment You?ll Need

To shingle your own roof, you?ll need some basic equipment such as:

  • Hammer
  • Chalk line
  • Utility knife
  • Level
  • Caulking gun
  • Scaffolding
  • Ladder

A pneumatic nail gun is optional but highly recommended.

Before You Begin

Before installing new shingles, the old ones need to be removed. Once the shingles are gone, you can inspect your roof sheathing for any defects. Both of these tasks are fairly easy to do, but basic roofing knowledge and the right tools make for a much easier job.

The Steps in Shingling a Roof

Installing shingles is a multi-step process, and each step must be done in the correct order to ensure the water-tightness and firm attachment of the roof.

  1. Lay out the roofing felt or paper. It should cover the entire roof, and should be attached with roofing nails to keep it in position without damage. Begin at the roof?s bottom edge, overlapping edges by a minimum of two inches. Leave an inch at the sides and bottom (don?t worry, they?ll be neatened later).
  2. Attach the drip edging. This is a metal piece affixed to the eave?s side and it covers the edges of the roofing paper. Its purpose is to keep water from seeping in and causing damage, and it?s easy to install. All you need to do is lay it atop the paper in the appropriate position, and nail down every foot (be sure to overlap).
  3. Start attaching shingles. Your first row should be installed upside down, with the tabs pointing toward the roof. The second row goes right on top in a slightly staggered fashion, with the tabs facing down. Once the double row is installed, you can use it to lay out a line of chalk every 10? from roof bottom to top. Doing this will keep shingles evenly spaced and straight.
  4. Install the main area?s shingles. After the first row is laid out, shingling the rest of the roof will be fairly easy. Remember to overlap joints horizontally, staggering the shingles & leaving a 1/16? gap. To accomplish this goal, you will have to halve a few shingles on alternate rows. Each shingle must be nailed at its top with no less than four nails, and the bottom of the next row of shingles should cover the nails. If installing an exhaust vent or rooftop Velux window, it should be put in before the shingles are installed.
  5. Add hip or ridge shingles. Where roof surfaces touch, shingles should touch but they shouldn?t overlap. Here, you?ll be using special shingles to cover the joints and provide a finished look to the job. As with the regular shingles, you?ll begin at the roof bottom, adding a dual row and working your way toward the top.
  6. Seal the roof. Your shingling job is almost complete, but you?ll still need a spatula, caulking gun or other similar tool to add a sealant to exhaust vents and joints which aren?t covered by hip or ridge shingles.

Safety is key when toting roofing materials up to the job site. Heavy materials, power tools and heights can all add up to disaster; take your time and don?t try to do work beyond the scope of your knowledge. When the work is done, don?t forget to pick up all tools and check for stray nails. Keeping the above tips in mind will ensure that your roofing job is finished safely and adequately.

When getting ready for an interview, it is important to not only prepare yourself to answer the questions you may be asked, but also questions that you can ask the people who are interviewing you. Many job seekers get so excited about finally getting an interview opportunity that they forget that interviewing is a two-way street. Yes ? you need to make sure that this company and job are a good fit for you! Otherwise, you?ll be going through the job search process all over again when you (or the company) realize that it just wasn?t a good fit.

But like with every other aspect of the job search process, the questions you ask during an interview can make a good or bad impression on the person with whom you are interviewing. First and foremost, asking no questions will leave a bad impression. Early on in the interview process, asking questions about salary, benefits, vacation time, dress code, holidays, etc., can come across as petty or self-interested.

Whenever I?ve interviewed for a position, I?ve always asked questions that enable me to connect with the interviewer by showing an interest in their personal story. The following questions will help you both connect with your interviewers, and also give you the type of insight you need to determine if this is the job for you.

Relapse or recovery? Neuroimaging predicts course of substance addiction treatment

ScienceDaily (Oct. 14, 2012) ? An Indiana University study has provided preliminary evidence that by measuring brain activity through the use of neuroimaging, researchers can predict who is likely to have an easier time getting off drugs and alcohol, and who will need extra help.

"We can also see how brain activity changes as people recover from their addictions," said Joshua Brown, assistant professor in the Department of Psychological and Brain Sciences at Indiana University Bloomington, part of the College of Arts and Sciences.

The chronic occurrence of relapse underscores the need for improved methods of treatment and relapse prevention. One potential cause for relapse is deficient self-regulatory control over behavior and decision-making. Specifically this lack of self-regulatory ability in substance dependent individuals has been associated with dysfunction of a mesolimbic-frontal brain network. Reduced activity within this self-regulatory brain network has previously been implicated in relapse, but the specific relationship between this network, self-regulatory ability and recovery is yet to be determined.

The current study explores neurophysiological and cognitive indicators of self-regulatory ability in a community-based sample of substance dependent individuals during the first three months of addiction treatment. The study tests participants' risk-taking inclinations through what is called a Balloon Analog Risk Task, a game in which the participants can decide whether to add increasing amounts of air to a balloon, gaining rewards until it pops. Those who took greater risks were shown to have reduced brain activity. By the same token, those who took less risk showed greater brain activity. By three months those who were successful in treatment also demonstrated a pattern of brain activation that coincided with the risk level of cues during the balloon risk task decision-making. In individuals who relapsed, risk-related activation was limited to certain brain regions, possibly signaling the anticipated reward rather than the risk of negative outcome.

First Lawsuit Filed Amid Calls for Investigation into Meningitis Outbreak

A woman in Minnesota has filed the first lawsuit in relation to the ongoing outbreak of fungal meningitis that has swept across the nation, according to Reuters and other media outlets on Friday. The woman has alleged that she was one of the estimated 14,000 people who were given spinal injections that have been identified as being possible carriers of the fungus Aspergillus.

She also alleged in her lawsuit that she has "experienced symptoms consistent with meningitis" and that she has undergone testing to determine if she contracted the disease after having injections to treat back pain, according to the Reuters report. More than 170 people have now been confirmed to have contracted meningitis, and 14 have died, according to a tally published by USA Today late Thursday.

Here is some of the key information regarding the meningitis outbreak and pending government and legal action related to it.

* Both state and federal officials are pushing for legislation in the wake of the outbreak. NBC News reported on Thursday that lawmakers are pursuing an expansion of their power to regulate pharmacies like the New England Compounding Center, which compounded the tainted injections.

* The New England Compounding Center, which is located in Massachusetts, had reportedly been cited before, in 2006, and was allowed to keep operating.

* Officials say the facility has been breaking both federal and state laws, but a local branch of the U.S. Food and Drug Administration has said that it did not have the legal jurisdiction to halt their operations.

* The NECC has now voluntarily shut down all of its operations and recalled all of the medications that it had recently processed. In a report by CNN on Wednesday, the CDC stated that the injections in question, which contain the steroid methylprednilosone, were administered to patients between May 21 and Sept. 24,

* The injections were distributed to 75 facilities in 23 different states. Now, lawmakers in at least two of those states have already begun to develop legislation to impose stricter standards on compounding facilities, which Rep. Edward Markey (D-Mass.) told CNN "are a 19th century service operating in a 21st century industry."

* Rep. Rosa DeLauro (D-Conn.), has also stated that she is working on legislation to introduce stricter regulations on such facilities in her own state as well.

* Sen. Richard Blumenthal (D-Conn.), who sits on the Senate Health, Education, Labor and Pensions Committee, told Reuters on Friday that he was seeking an investigation by the Justice Department into NECC's operations, saying that while he has "reached no conclusion," he believes there are "sufficient facts to warrant an investigation."

(AP) ? At its prime, the space shuttle Endeavour circled the globe at 17,500 mph, faster than a speeding bullet.

In retirement, it's crawling along the streets of Los Angeles at a sluggish 2 mph, a pace that rush-hour commuters can sympathize with.

Endeavour's two-day, 12-mile road trip to the California Science Center where it will be put on display kicked off around midnight Friday. Rolled on a 160-wheeled carrier, it left from a hangar at the Los Angeles International Airport, passing diamond-shaped "Shuttle Xing" signs, and reached city streets about two hours later.

Hundreds of spectators waiting in the predawn darkness snapped photos and gaped as the 170,000-pound Endeavour inched by with its tail towering over streetlights and its wings spanning the roadway. Some had pajama-clad children in tow.

The shuttle made stop-and-go progress, with some halts to check its balance and to prune trees in its path as it rolled past strip malls and storefronts.

In a massive feat of parallel parking, the shuttle was backed into a shopping center parking lot around 5:30 a.m. ? later than expected.

Janet Dion, a family therapist from nearby Manhattan Beach, was in awe to see the shuttle, its sides weathered by millions of miles in space and two dozen re-entries.

"It's exciting to see the tiles up close, especially the texture of the tiles," she said. "It's amazing. You can almost feel the fabric of it, like a skin. Like our skin."

Endeavour will remain at the parking lot for a nine-hour layover as crews worked to widen the carrier so that it could straddle the median during the next part of the trip. It was expected to move again in early afternoon then stop for several more hours to transfer to a special dolly for the cross over the busy Interstate 405 at night.

Ushering a shuttle through an urban core is a logistical challenge that took almost a year to plan. Guarded by a security detail reminiscent of a presidential visit, police enforced rolling street and sidewalk closures as early as Thursday night in some locations and discouraged spectators from swarming side streets.

The behemoth transport has caused headaches for shopkeepers along the route who counted on cheering crowds jamming the curbs to boost business.

In the days leading up to Endeavour's move, the owners of Randy's Donuts sold shuttle-shaped pastries emblazoned with the NASA logo and even hung a shuttle replica inside the giant doughnut hole sign visible from the busy Interstate 405.

Co-owner Larry Weintraub planned to watch the shuttle creep by the roadside sign, which has been featured in several movies. But the store, which serves up sweets 24-7, will be closed Friday night.

"I'm still excited, but I'm disappointed that people aren't going to be able to stand in the streets and shout 'Yay,'" he said.

Saturday is typically the busiest day for James Fugate, who co-owns Eso Won Books in South Los Angeles. But with Endeavour expected to shuffle through, Fugate braced for a ho-hum day in sales.

"We don't close because we're slow. That's when you pull out a book to read," he said.

The baby of the shuttle fleet, Endeavour replaced Challenger, which exploded during liftoff in 1986, killing seven astronauts. It thundered off the launch pad 25 times, orbited Earth nearly 4,700 times and racked up 123 million miles.

Last month, it wowed throngs with a dizzying aerial loop, soaring over the state Capitol, Golden Gate Bridge, Hollywood Sign and other California landmarks while strapped to the back of a modified 747 before finally landing at LAX.

The last leg of Endeavour's retirement journey skips the tourist attractions and instead, winds through blue-collar communities in southern Los Angeles County. While viewing will be severely curtailed due to sidewalk shutdowns, crowds are still expected.

Moving the Endeavour required a specialized carrier typically used to haul oil rigs, bridges and heavy equipment. The wheels can spin in any direction, allowing the shuttle to zigzag past obstacles. An operator walks alongside, controlling the movements via joystick. Several spotters along the wings are on the lookout for hazards.

To make room for the five-story-tall shuttle and its 78-foot wingspan, some 400 trees were chopped down, cable and telephone lines were raised, and steel plates were laid down to protect the streets and underground utilities.

Endeavour will mostly travel on wide boulevards with some boasting as many lanes as a freeway. While there have been advance preparations, there is remaining work to be done during the move, including de-energizing power lines. Southern California Edison warned of outages in the suburb of Inglewood.

One of the trickiest parts involves trundling through a narrow residential street with apartment buildings on both sides. With Endeavour's wings expected to intrude into driveways, residents have been told to stay indoors until the shuttle passes.

The route was selected after ruling out other options. Dismantling the shuttle would have ruined the delicate heat tiles. Helicoptering it to its destination was not feasible. Neither was crossing on freeways since the shuttle is too big to fit through the underpasses. The cost of transporting it cross-town was estimated at over $10 million.

As complex as the latest endeavor is, Southern California is no stranger to moving heavy things.

In 1946, Howard Hughes' "Spruce Goose" aircraft was built in sections and hauled from Culver City to Long Beach, 30 miles away. In 1984, an old United Airlines DC-8, with its wings and tail disassembled, was towed from Long Beach to the science center.

Earlier this year, a two-story-tall chunk of granite was hauled 105 miles from a rock quarry to the Los Angeles County Museum of Art.

When you and employer split, sparks can fly over social media

If you and your company get an ugly divorce, does your company get to keep the friends?

A controversial court ruling last week has shined a light on this made-in-the-digital age problem: Who owns Twitter followers, Facebook friends and LinkedIn connections when employers and employees part ways? With personal and professional lives mingled online as never before, a distinctly 21st Century fight is brewing over who owns your friendships.

A ?federal judge in Pennsylvania on Oct. 4 rejected a claim by Linda Eagle that her prior employee had illegally accessed her LinkedIn account after she left her company, Edcomm. Workers there changed Eagle's password after her departure, preventing her from accessing critical contacts and, she claimed, damaged her ability to find new work.?

But the judge dismissed most elements of her lawsuit, giving fuel to those who argue that social media groomed at work belongs to employers.

"The initial outcome of the case is very troubling," said Bradley Shear, a Washington, D.C.,-area lawyer who specializes in social media. It opens the door for employers to claim ownership of any social account -- even personal accounts -- because Eagle's account was created under her own name, he warned. "It demonstrates there's a need for people to become much more educated about this."


Other court rulings have hinted that courts might be inclined to see things the employer's way.? Earlier this year, a federal California court allowed a publication named PhoneDog to proceed with a lawsuit against former writer Noah Kravitz, who had amassed 17,000 Twitter followers while working there.

Kravitz claimed the followers were his, but PhoneDog sued for ownership in 2011, and the judge denied a motion to dismiss the case in a February ruling ? a positive sign for PhoneDog?s legal argument. Two other recent cases also sided with firms making ownership claims on social media contacts.

Eric Goldman, a law professor at Santa Clara University, cautioned that each of these cases is "incredibly fact specific," and none establishes a universal principle that could be widely applied. Still, workers should be on notice that their employer getting their ?friends in the divorce is not so far-fetched.

"People should learn from this that it's dangerous to mix business with pleasure," he said.

In many ways, the "who owns the connections and the conversations" issue is unique to social media and the digital age.? In the past, there was never any question that a public relations professional was speaking on behalf of a company, and that communication was company-owned ?? ?as were the contact lists. But what of a long-time flack who arrives at a new firm with a long list of her own Twitter followers, and who writes messages using that account that are decidedly personal?? Who owns those messages, and those contacts? The issue is as murky as most employees' work-life balance.

?Many of these accounts have 'mingled interests,' " Goldman said. ?That makes things difficult.?

In fact, the very nature of social media means the accounts don't really work unless they have a touch of personality. Tweeted press releases aren't interesting on Twitter; personal wit is regarded above all, and encouraged at every smart firm with a social media presence.?

On the other hand, it's reasonable to think of LinkedIn contacts as akin to customer lists, which are clearly proprietary and belong to employers as intellectual property. For decades, firms have claimed ownership of client lists (and employees have tried sneak out the door with them). If a LinkedIn account is little more than a list of business connections that are directly related to a job, why wouldn't a company claim it?

Of course, fights over Rolodexes aren?t new ? but old-fashioned piles of business cards make a poor analogy for a long-curated group of Twitter followers. ?Besides, users who have a developed a personal relationship with a social media creator aren't likely to be much use to a company which takes over an account, Goldman noted.

?You can grab the Rolodex, but you can?t really grab the relationship?? he said.

There's also the subtle "you are nothing without me" argument. When television anchor and early Twitter adopter Rick Sanchez left CNN, he had a follower list of 150,000. Without CNN, Sanchez would not have compiled such a following, and when he left, observers imagined a brewing controversy. A fight was averted when CNN Sanchez keep the list as long as he changed his Twitter handle, from @ricksanchezcnn to @ricksancheznews .

LinkedIn hasn't offered a lot of guidance in the issue, but in a brief statement to NBC News, the company seemed to suggest that it might take up the fight on behalf of users at some point.

"We don't know the specific facts and circumstances of the relationships or agreements between Ms. Eagle and her former employer, nor are we parties to the lawsuit, so we can't comment on it specifically," said LinkedIn spokesman Hani Durzy. "However, LinkedIn prides itself on being a members-first organization, and in general we believe that a member's professional profile belongs to them.?

Other digital-era issues offer conflicting notions.? In the United States, employees have no right to privacy over emails they write at work, even if they are using personal email accounts. Employers are within their rights to employ snooping software to watch everything workers do with company computers.? That might suggest any Facebook or Twitter work done by an employee on company property belongs to the company. On the other hand, there's a long history of domain name confusion that sides with workers. Employees who register company domains in their own names, for example, often end up with an awful lot of leverage after they leave the company -- they can redirect the domain, for example.

To Shear, the lawyer specializing in social media, that leads to a practical question for companies that might be inclined to make claims on social media accounts.

"LinkedIn is an external system. Why are you are putting resources into an external system that you don't have control over?? Companies prefer their own email to Gmail for this reason," he said.?

One critical element of the Eagle case is that she had shared her password with a coworker, who updated the LinkedIn page for her. That put the company in a good position to make a claim -- it could change the password, lock her out and ask questions later.? So should employees refuse such password sharing? Some companies compel users to do so, though increasingly state legislatures are considering laws making the practice illegal. ?Meanwhile, most social networks -- including LinkedIn -- say it's against their terms of service to share passwords.

There may already be existing laws that cover a lot of this controversy. Non-compete and non-solicitation agreements -- which prevent workers from contacting clients after exiting a firm -- prevent a lot of the issues that businesses are really concerned about when they make social media contact claims.? Still, those are often unenforceable, particularly in California, which has broad employment right laws. That has Shear and Goldman concerned that future employment agreements will contain the broadest possible provisions, with companies seeking rights to all online relationships while workers are in their employ.

"That would be an egregious overreach," Goldman warned.

It would also kill the spirit of social media, as popular Twitter posters would disappear overnight, each time they change jobs.

"In the end, we as readers will be the losers, because we won't be able to find the people we are looking for," he said

There is one saving grace in this discussion: Despite our pride of amassing a few thousand friends or followers, Goldman points out that most social media accounts are not so valuable that they are worth fighting over in court.

"The economics don't support litigation," he said. "How much is an account with 17,000 followers worth?? At $1 a follower, that's $17,000 -- that would hardly even get (the lawsuit) filed."

Both Shear and Goldman stressed that companies need to have very specific social media policies -- pre-nuptial agreements, if you will -- specifying who gets what when the inevitable breakup arrives.?

For workers who are concerned, Shear offers three quick tips.

  • Make sure the email used to set up the social networking account is a personal email that you control, not a corporate email address that can be cut off -- and could be used as evidence of ownership in litigation. Also, use personal contact information, such as a home number and address.
  • Make sure the name on the account is personal -- Sally Smith, not Sally_XYZCompany. Finally, use a personal photograph, rather than a company logo, in the profile picture.

Welcome back to Foundation Friday. ?This week I bring you a foundation from Down Under?.No You SICK-O's not that. I mean Australia.

Become Beauty has a huge range of products including skin care and makeup. ?They have a few different lines of skin care, but the Makeup line is limited, simple and straightforward. ?I was sent a tube of the Firm + Tone Mineral Foundation. ?This is a multi-purpose foundation with 30 SPF UVB/UVA protection. It provides translucent coverage in a universal shade (more on that in a second), it helps protect, firm and tone the skin with anti-aging ingredients. The foundation contains?Zinc and Titanium, natural sunscreens,?DMAE?Extract which is an antioxidant and soothes the skin,?Mica, which reduces the appearance of lines and silica which gives a flawless look to the coverage.

Guess what. ?My skin color was not in that "universal" shade range. ?But I soldiered on and tested it, so I could at least tell you how it works. I actually wore it for 2 straight days while I was home on the weekend. (I don't really care if someone at the grocery store sees me with foundation that doesn't match my skin tone.) Since my weekends consist of doing nothing but indulging Darthypie and catching up on lost sleep I was happy to test this out. ?As I said I wore this foundation for two days and getting it to look natural on my pale complexion was a bit of a challenge, but I figured out, on day 2, that if I applied it to the middle of my face, blended out and then used another BB cream on the outside of my face and blend inwards, this foundation could look pretty decent.

I know what you are thinking. ?"Wait a second. How can you review a product after only 2 days of use. ?Don't you normally take weeks to test a product?" ?Yes. I do normally take weeks to test a product. ?I'll tell you why I only took 2 days in just a moment. ?But first...

You all are probably wondering about the color. ?So here it is.


Yup. It's pretty dark and orangey/yellow for me. ?I think darker skin tones would benefit from this much more than I did. ?I do not like that this foundation only comes in one color. ?That's just not cool.

As for how it holds up. Actually quite nicely. ?Applied all over my face with primer on day one the finish was slightly matte and natural looking (despite the color) ?My skin did seem slightly toned and firmer when I was wearing this?but I stress that it was a slight improvement. ?The foundation did a good job of covering up my pores and not settling into fine lines. ?It looked pretty Awesome actually, despite the poor color match. It seemed to fade on my oily skin after 4-5 hours, but that is to be expected with any foundation touted as a translucent finish. ?By the time I figured out how to apply it with a BB cream closer to my skin tone I looked pretty amazing. ?I was ready to recommend this foundation for darker skin tones right away.

But then it happened. ?I started to break out. ?I started to break out in painful cystic like acne in areas of my face that never break out. ?It was then I FINALLY looked at the ingredients and I saw that one word that strikes dread into my cold black heart. ?Cyclopentasiloxane. Yup. That dreaded silicone that is in countless makeup products. ?It's not typical to react the way I do to?Cyclopentasiloxane, but it is possible. ?Yup. ?This is one of the few silicones that makes me break out in huge hurty cystic acne. ?It sucks, because some products that are really awesome contain this ingredient. ?But, like I said, my reaction is not typical and most people can, and are, currently wearing this silicone on a daily basis with no issues what so ever. ?And that is why I didn't test this foundation for more than 2 days.

So do you NEED this? ?I know I certainly do not. ?You might need this. ?If you don't have issues with?Cyclopentasiloxane and you aren't?any lighter than a MAC NC20 or Darker than a MAC NC35. ?(A MAC NC40 might be able to make this work.) this could work for you. That's a pretty narrow window of skin tones if you ask me but the majority of the US falls into this range. ? Perhaps as Become Beauty expands they will also expand their range of colors for the Firm + Tone Mineral Foundation. ?That way women of color and non color (like myself) can also benefit from this product. ?However, I will never benefit from it as long as?Cyclopentasiloxane is in it. ?It's not fair to condemn a product just because?Cyclopentasiloxane is the main ingredient. I get that. I know my reaction is not typical. ?

So what am I going to do with a tube of Mineral foundation that is skin suicide for me? ?I'm going to give it to my buddy that doesn't have this reaction to?Cyclopentasiloxane and has much darker skin than I do. ?But what about you dear reader? ?Perhaps you too are yearning for this foundation because you have the ideal skin coloring and no issues with?Cyclopentasiloxane. ?Just because I personally didn't like a product for non typical skin reaction I experienced doesn't mean that YOU won't like it. ?I get that we are all special snow flakes and that everyone is different. ?That's why I agreed to hold a giveaway!
